Compare and contrast the role and function of judges, lawyers and
lay people within the English courts

1.0 TERMS OF REFERENCE
1.1. On Tuesday 23rd of January …. asked me to create a report about the
similarities and differences of the role of the judges, lawyers and lay people that are
part of the English legal system.

2.0 PROCEDURE
2.1 In order to write this report I will use the following information: -
- the notes from my classroom
- the information from P4 and P5
- the internet sources about the English courts

3.0 FINDINGS
Firstly English legal system is divided into two parts : the civil court and the criminal
court.Furthermore each sides has its own courts and procedures.Criminal law is the
law of crime and punishment whereby the Crown prosecutes the accused. Civil law
is concerned with tort, contract, families, companies and so on. Civil law courts
operate to provide a party who has an enforceable claim with a remedy such as
damages or a declaration.
In addition in both sides there are people who are hearing the cases whereas are
linked to civilians, crimes or organisations. Those people could be either lay people
as magistrates or juries or judges, lawyers and barristers. The role of each individual
in the English legal system differ from case to case however there are some
similarities as well.

3.1 Judges
Judges are the public official appointed that decide cases in a court of law.In order to
become a judge the individual must be legally qualified and also must posses a
previous experience within the hearing in the English legal courts either in civil or
criminal law.Furthermore the judges has very important roles in the English legal
system , one of the main role s to preside over the trial. They are doing this by being
aware that all parties follow the procedure and rules of the court as this side is very
crucial for each individual hearings. Therefore it ensures that no party is treated
differently than another and everything is in a fair way. They must act impartially and
without bias. Judges are appointed to a case in view of their qualification and
experience which will help them deal with the case.In addition a judge has the
responsibility to direct and help the jury as to what the law is.The judge will also sum
up the evidence for the jury towards the end of the trial. They also have the authority
of releasing the jury when their job is done.In terms of their work done , a judge has
a regularly salary and a regular task to do.However ,judges are coming from an elitist
