Onderscheid tussen rechtssubjecten en rechtspersonen en rechtsobjecten
1. Rechtssubject = natuurlijke persoon
2. Onderneming of vennootschap
3. Rechtsobject = goederen en dieren
Eigen recht van toepassing op iedere categorie
H1. Goederen: soorten en belang
1. Materiële / lichamelijke goederen
Voorbeeld: auto, boek, testament (papier zelf)
2. Immateriële / onlichamelijke goederen
Voorbeeld: copyright, testament (wat je erin schrijft), handelszaak (want
bestaat ook uit cliënten, belastingen)
Onroerende goederen (OG) (= niet verplaatsbaar)
1. OG uit hun aard (iets wat van nature onverplaatsbaar is) OF
incorporatie (gemaakt uit materialen die los van elkaar verplaatsbaar
zijn, maar eens ingecorporeerd worden ze vastgemaakt in grond)
Voorbeeld: brug, huis met zonnepaneel, appelboom, leiding in huis
2. Onroerende goederen door bestemming (= roerende goederen, maar
doordat ze economisch verband hebben met onroerend goed worden
ze onroerend)
Twee voorwaarden:
RG en OG moeten aan zelfde eigenaar toebehoren
Bindteken: economisch of materieel
Voorbeeld: hangbord van winkel, koe (RG, maar samen met landbouw
en bedrijf dus OG)
3. OG door het voorwerp waarop ze betrekking hebben (rechten)
Voorbeeld: huis, weg
Roerende goederen (RG)
1. RG uit hun aard (verplaatsbaar)
Voorbeeld: hond, auto, gsm
2. RG door wetsbepaling (=rechten vb eigendomsrecht dat je hebt op
OG)
Voorbeeld: pc, geld (recht dat je nog te goed hebt van iemand of moet
geven), politie die iemand beveelt om weg te gaan (recht om iets wel
of niet te doen vb contactverbod)
3. RG door anticipatie (= je loopt op de feiten voorop)
