Baker v Carr (1962) ANS -- a 1901 law designed to apportion the seats for the General Assembly was
ignored. Case details how reapportionment efforts ignored significant economic growth and population
shifts.

- Did the Supreme Court have jurisdiction over questions of legislative apportionment?

- Court held that there were no such questions to be answered in this case and that legislative
apportionment was a justiciable issue

- Concluded that the 14th amendment equal protection issue which Baker and others raised in this case
merited judicial evaluation.



Shaw v Reno (1993) ANS -- Weirdly shaped North Carolina district upset people. NC residents challenged
it and said it was only used to get black representatives.

- Failed to state a constitutional claim and later appealed to higher courts.

- Did the NC residents' claim, that the State created a racially gerrymandered district, raise a valid
constitutional issue under the 14th Amendment Equal Protection clause?

- The shape of the proposed district was odd that there was no compelling explanation for its shape
other than race.

- Must take into account the provision of the voting rights act, race cannot be a predominant face in
drawing districts.

- Redistricting can be held to the same legal standards as laws that explicitly classify by race. Legislative
districts cannot be based on by race.
