When a psychologist places his license on Inactive Status vs. Expiration
of License, what does the psychologist need to do to reactivate the
license? - ANSWER A psychologist who places his/her license on
Inactive status must sumbit the fees and 36 CE credits. The psychologist
DOES NOT need to take the EPPP or the CPLEE when they place their
license on INACTIVE status.

A psychologist who had been licensed in California and allowed his/her
license to EXPIRE, the psychologist would need to submit the fees and
take and pass the CPLEE

Can the psychologist claim the privilege when there is no holder of the
privilege in existence? - ANSWER The psychotherapist is generally
required to claim privilege when the patient-therapist communication is
sought to be disclosed; however, the therapist may not claim privilege if
there is no holder of privilege in existence, or if the therapist is instructed
by a person authorized to permit disclosure.

1. Can a licensed psychologist from a foreign country work in your
practice as a licensed psychologist?

2. Under what circumstances can a licensed psychologist in a foreign
country work in your practice? - ANSWER 1. NO.

2. The foreign psychologist CAN be a psychological assistant if
approved by the California Board of Psychology OR becomes licensed
in CA.

CANNOT:

1. A psychologist licensed in a foreign country (despite the number of
years licensed or not being subject to any discipline) CANNOT work as a
licensed psychologist in CA unless
- he/she has taken the required coursework deemed by the BOP.

,- passed the EPPP (an exception to Canadians) and CPLEE

Note: The foreign psychologist CANNOT pass the CPLEE and expect to
be licensed in CA (may need additional coursework).

NOTE: if a foreign license is outside of Canada, the psychologist may
need to take the EPPP. That is, Canadians take the EPPP.

2. There is NO such thing as reciprocity for other states or countries in
terms of a CA license

Licensee is on probation - Year(s) and petition - ANSWER 1. A
psychologist must wait 1 year to petition for "early termination of
probation" of LESS than 3 years.

2. A psychologist must wait at least 2 years to petition for early
termination of probation that is 3 years or MORE!

When a licensee is placed on probation, the psychology license is
revoked and the revocation is "stayed" which means the revocation is
not actually executed. The probationary period, terms, and conditions
are applied.

Dr. Smith was found guilty of unprofessional conduct and was placed on
probation for 5 years. As part of his probation, his practice will be
monitored. In this case, Dr. Smith must - ANSWER inform patients about
ANY aspect of probation that will impact therapy ORRRR the
confidentiality of records. In this case, since the practice is being
monitored, the psychologist must notify the patient.

***Such notification shall be SIGNED by the patient prior to continuing or
commencing treatment*** NOTE: if the probation does not affect therapy
or confidentiality, the therapist is only required to inform the patient when
the patient's asks (this is part of the patient's bill of rights)

1. Telehealth services for a psychologist who resides out of state AND is
licensed out of state

,2. Telehealth services for a psychologist who is located in CA, but is
licensed out of state. - ANSWER CA requires that any psychologist
providing telehealth services to a CA resident MUST BE licensed in
California OR located within the state lines of CA.

1. Thus, a psychologist who resides OUTSIDE of CA and is licensed
OUTSIDE of CA is in violation of the law. This psychologist is NOT
permitted 30 calendar days to provide telehealth services to a CA
resident when he/she is providing therapy OUTSIDE state lines.

2. If a psychologist is licensed out of state BUT is in the state lines of
CA, he/she can provide telehealth services to a CA resident for up to 30
calendar days.

Note: Look for the location of the psychologist and the state of license in
this question!

When a patient is in a crisis (laid off of work and going through a
divorce) and states she can no longer pay your fee, what is your ethical
obligation?

A. Continue to see the patient through the crisis period and arrange for
her to pay at a reduced fee she can afford

B. Continue to see the patient for a number of termination sessions and
see her probono

C. Send a referral to a low-cost clinic. - ANSWER A. In an emergency
situation, the therapist has an obligation to see the patient until the crisis
has resolved, regardless of whether the patient can pay the fee. Thus, B.
suggests that you would provide a number of termination sessions and
although they are probono, this does not suggest that the crisis would be
resolved at the end of the agreed upon number of sessions.

According to CA Law, psychotropic drugs may be administered to a
minor (3 ways) - ANSWER With the consent of the parent/legal
guardian, with the consent of an emancipated minor or self-sufficient

, minor if the therapist believes he/she is competent to give informed
consent OR ***valid court order***
(and of course in emergency situations to preserve life)

A health provider may release PHI for clinical research purposes
***without patient authorization*** under what circumstances (3 items) -
ANSWER The requirements of HIPAA's Privacy Rule and CA Civil Code
Section are inconsistent with regard to the release of information for
research purposes. However, the requirements of HIPAA preempt CA
Law because they are more stringent (provide the patient with greater
privacy protection)

1. Approval from the IRB or Privacy Board
2. Patient is deceased
3. A limited data set that excludes direct identifiers is provided under a
data use agreement between the health provider and the researcher.

What are HIPAA's 3 Rules? - ANSWER Privacy - Provides regulations
for using and disclosing

Security - Describes Safeguards for electronic PHI

Transaction - Required providers who transmit electronic transactions to
use the same electronic format, code sets, and identifiers.

HIPAA's Privacy Rule VS. CA State Law - Patient representative
requesting access to patient records - ANSWER One of the three
reasons HIPAA allows the health care professional to deny access to a
patient records is

"when the request was made by the patient's personal representative
and the health care professional believes the disclose to that
representative is ***likely to cause substantial harm to the client or
another person*** BUT

***CA Law preempts the privacy rule*** because CA law does NOT
allow a health care provider to withhold records from a patient's
