Section66003.0026Applicability6of6Chapter6-6ans--
(a)6This6chapter6does6not6apply6to:6(1)6an6employee6of6the6United6States,6this6state,6or6a
ny6political6subdivision6of6this6state6who6acts6as6a6fire6protection6sprinkler6system6contra
ctor6for6the6employing6governmental6entity;6(2)6the6plan,6sale,6installation,6maintenance,6
or6servicing6of6a6fire6protection6sprinkler6system6in6any6property6owned6by6the6United6Sta
tes6or6this6state;6(3)6an6individual6or6organization6acting6under6court6order6as6authorizati
on;6(4)6an6individual6or6organization6that6sells6or6supplies6products6or6materials6to6a6regi
stered6fire6protection6sprinkler6system6contractor;6(5)6an6installation,6maintenance,6or6ser
vice6project6for6which6the6total6contract6price6for6labor,6materials,6and6all6other6services6i
s6less6than6$100,6if:6(A)6the6project6is6not6a6part6of6a6complete6or6more6costly6project,6wh
ether6the6complete6project6is6to6be6undertaken6by6one6or6more6fire6protection6sprinkler6s
ystem6contractors;6or6(B)6the6project6is6not6divided6into6contracts6of6less6than6$1006for6th
e6purpose6of6evading6this6chapter;6(6)6an6engineer6licensed6under6Chapter61001,6Occup
ations6Code,6acting6solely6in6the6engineer's6professional6capacity;6(7)6a6regular6employe
e6of6a6registered6fire6protection6sprinkler6system6contractor;6or6(8)6an6owner6or6lessee6of6
property6that:6(A)6installs6a6fire6protection6sprinkler6system6on6the6owned6or6leased6prop
erty6for6the6owner's6or6lessee's6own6use6or6for6family6members'6use;6and6(B)6does6not6off
er6the6property6for6sale6or6lease6before6the6first6anniversary6of6the6date6of6installation6of6t
he6fire6protection6sprinkler6system.6(b)6This6chapter6does6not6authorize6an6individual6or6o
rganization6to6practice6professional6engineering6other6than6in6compliance6with6Chapter61
001,6Occupations6Code
Section66003.0036Effect6on6Local6Regulation6-6ans--
(a)6This6chapter6and6the6rules6adopted6under6this6chapter6have6uniform6force6and6effect6
throughout6this6state.6A6municipality6or6county6may6not6enact6an6order,6ordinance,6or6rul
e6requiring6a6fire6protection6sprinkler6system6contractor6to6obtain6a6registration6certificate
6from6the6municipality6or6county.6A6municipality6or6county6may6not6impose6on6a6fire6prote
ction6sprinkler6system6contractor6qualification6or6financial6responsibility6requirements6oth
er6than6proof6of6a6registration6certificate.6(b)6Notwithstanding6any6other6provision6of6this6
chapter,6a6municipality6or6county6may6require6a6fire6protection6sprinkler6system6contracto
r6to6obtain6a6permit6and6pay6a6permit6fee6for6the6installation6of6a6fire6protection6sprinkler6
system6and6require6the6installation6of6a6fire6protection6sprinkler6system6to6conform6to6the
6building6code6or6other6construction6requirements 6of6the6municipality6or6county.6(c)6A6mu
, nicipal6or6county6order,6ordinance,6or6rule6in6effect6on6September61,61983,6is6not6invalida
ted6because6of6any6provision6of6this6chapter.
Section66003.0516Administration6of6Chapter6-6ans--
(a)6The6department6shall6administer6this6chapter.6(b)6The6commissioner6may6issue6rules6
necessary6to6administer6this6chapter6through6the6state6fire6marshal.
Section66003.0526Adoption6of6Rules6-6ans--
(a)6In6adopting6necessary6rules,6the6commissioner6may6use6recognized6standards,6inclu
ding6standards:6(1)6adopted6by6federal6law6or6regulation;6(2)6published6by6a6nationally6re
cognized6standards-
making6organization;6or6(3)6developed6by6individual6manufacturers.6(b)6Under6rules6adop
ted6under6Section66003.051(b),6the6department6may6create6a6specialized6licensing6or6re
gistration6program6for6fire6protection6sprinkler6system6contractors.
Section66003.0536Rules6Restricting6Advertising6or6Competitive6Bidding6-6ans--
(a)6The6commissioner6may6not6adopt6rules6restricting6advertising6or6competitive6bidding6
by6the6holder6of6a6license6or6registration6certificate6issued6under6this6chapter6except6to6p
rohibit6false,6misleading,6or6deceptive6practices.6(b)6In6the6commissioner's6rules6to6prohi
bit6false,6misleading,6or6deceptive6practices,6the6commissioner6may6not6include6a6rule6th
at:6(1)6restricts6the6use6of6any6medium6for6advertising;6(2)6restricts6the6use6of6a6license6or
6registration6certificate6holder's6personal6appearance6or6voice6in6an6advertisement;6(3)6re
lates6to6the6size6or6duration6of6an6advertisement6by6the6license6or6registration6certificate6
holder;6or6(4)6restricts6the6license6or6registration6certificate6holder's6advertisement6under6
a6trade6name.
Section66003.0546General6Powers6and6Duties6of6Commissioner,6State6Fire6Marshal,6an
d6Department6-6ans--
(a)6The6commissioner6may6delegate6authority6to6exercise6all6or6part6of6the6commissioner
's6functions,6powers,6and6duties6under6this6chapter,6including6the6issuance6of6licenses6a
nd6registration6certificates,6to6the6state6fire6marshal.6The6state6fire6marshal6shall6implem
ent6the6rules6adopted6by6the6commissioner6for6the6protection6and6preservation6of6life6an
d6property6in6controlling:6(1)6the6registration6of6an6individual6or6an6organization6engaged6
in6the6business6of6planning,6selling,6installing,6maintaining,6or6servicing6fire6protection6sp
rinkler6systems;6and6(2)6the6requirements6for6the6plan,6sale,6installation,6maintenance,6or
6servicing6of6fire6protection6sprinkler6systems6by:6(A)6determining6the6criteria6and6qualific
ations6for6registration6certificate6and6license6holders;6(B)6evaluating6the6qualifications6of6
an6applicant6for6a6registration6certificate6to6engage6in6the6business6of6planning,6selling,6i
nstalling,6maintaining,6or6servicing6fire6protection6sprinkler6systems;6(C)6conducting6exa
minations6and6evaluating6the6qualifications6of6a6license6applicant;6and6(D)6issuing6registr
ation6certificates6and6licenses6to6qualified6applicants.6(b)6The6commissioner6shall6establi
sh6a6procedure6for6reporting6and6processing6complaints6relating6to6the6business6of6plann
ing,6selling,6installing,6maintaining,6or6servicing6fire6protection6sprinkler6systems6in6this6st
