Negligent hiring is a legal claim by an injured individual against an employer based on idea

that the employer did know or should’ve known their employees background especially if the

employee had a hazy background. Companies have a duty to screen individuals of high

character and with clean backgrounds to prevent hiring individuals with questionable

backgrounds. If a company hires an employee with questionable background and there is an

incident involving that employee, then that company is ultimately responsible. Incidents that

could occur include threat to fellow employees, members of the public and overall workplace

safety. A company’s failure to conduct a proper background check is a common way to prove

negligent hiring.

One example of negligent hiring is the Navy Yard shooting that occurred on September 16,

2013 by an employee named Aaron Alexis (Tkachuk, 2013). Aaron Alexis was a Navy reservist

and contracted by the Navy to work on its information technology systems. He showed up to

work on September 16, 2013 with a shotgun disassembled in a bag that was slung over his

shoulder. Once he checked into work, he slipped into a restroom, assembled his shotgun and

started his rampage which lasted well over an hour. Police agencies responded promptly and in a

subsequent firefight were able to eradicate Mr. Alexis at the cost of twelve employees who were

killed, and numerous others injured. Further investigation by authorities revealed that the

government granted Mr. Alexis a security clearance despite the red flags in his background.

These issues in his background consisted of multiple run ins with several police departments and

had failed to mention these incidents during his background check. This is a clear example of

negligent hiring and the company was held liable by the federal government.
