- De uitkomst van het proces is niet een onafhankelijk criterium vanuit dat proces, maar een
onlosmakelijk onderdeel daarvan: de uitkomst is de laatste fase van dat proces.

o Casus: jongen van 12 jaar met hersentumor die geen chemo/bestraling meer wil.
Ofschoon dat statistisch gezien een hogere overlevingskans geeft. Moeder is
akkoord, vader niet. Vader gaat naar rechter. Moeder ‘wint’.
- Situatie niet hoog complex, maar besluit wel fikse consequenties voor patiënt -> hoge eisen
aan besef en waardering van de informatie
o Casus; hartpatiënt die niet gereanimeerd wil worden
- Wel of geen toestemming levensreddende of ingrijpende/belastende behandeling of gunstig
risk-benefit-ratio-> eisen aan beslisvaardigheid hoger
o Casus; jonge vrouw met anorexia. Handen acrocyanose, adem ketonisch, zwakke
pols. Levensbedreigend. Weigert behandeling
- De centrale vraag; “is de beslisvaardigheid goed?” (Niet de vraag; “is het besluit goed”)
Beoordeling van wilsbekwaamheid moet primair gericht zijn op het
besluitvormingsvermogen en niet op uitkomst van de beslissing
Beoordeling Wilsbekwaamheid
- Informed Consent stelt hoge eisen aan cognitieve functies. Wat te doen bij bijv.
dementerende of verstandelijk beperkte patiënten? Emoties, identiteitsbesef en
levensgeschiedenis zeggen wellicht ook veel over patiënt zijn “wil”
- Tijdelijke wilsonbekwaamheid; besluit uitstellen? Of juist ingrijpen? Voorbeeld; Psychotische
patiënt; onrustig en opgewonden, kortdurend sederen. Daarna patiënt voorstellen om
langwerkende depot neuroleptica te accepteren
- Partiële wilsonbekwaamheid; wie voor de éne beslissing onbekwaam is, hoeft dat niet voor
de ándere beslissing te zijn. Daarom bekwaamheid van patiënt per concrete beslissing
beoordelen
o Casus; demente bejaarde vrouw eet eerst dessert en daarna het voorgerecht. Wil
daarna ‘de kinderen van school halen’
Wie beslist?
- Probleem; als de patiënt niet meer kan beslissen, moet iemand anders het voor hem doen
- Oplossing; in gesprek blijven, ook met wilsonbekwame patiënt. Deze mag geen willoos object
worden
- Uitgangspunt; behandeling vermeerdert lijden niet en draagt bij aan welbevinden
Familie lijdt aan tragische bias (benadrukken lijden) en personeel aan rooskleurige bias
(bagatelliseren)
Verschillende visies en vooral emoties maken overleg en samenwerking tussen betrokkenen soms
moeilijk
