The Compliance Programs of Cabrini of Westchester (CoW) and Life Care Centers of America
(LCCA) is analyzed in this document. Both documents meet the Compliance Program Guidance
for Nursing Facilities. First, a summary of the main characteristics of each Compliance Program
will be presented and finally, a concept on the best practices of the analysis is presented. Both
healthcare organizations have a whole department in charge of compliance.
A key factor about these departments, regardless of how they name it (Committee or
Department), is their relationship with the board of directors of the organization, in both cases,
the head of the compliance department reports directly to the CEO, and not to the Financial or
Operational areas, this strategy is aimed to reduce the risk of conflict of interests. In the case of
LCCA, in addition to the chief of the compliance department, there is a compliance Advisory
Board that supports legal and training issues. The internal audits are carried out by the
Compliance Departments in both organizations. They do not provide much detail about the
methodology of monitoring and auditing but who oversees them. In the case of LCCA, they
adjust and review every year the auditing and monitoring plan.
The reporting of the non-compliance issues is encouraged in both organizations, guaranteeing
the confidentiality of the reporter, but Cabrini of Westchester has the most interesting program of
reporting. They have a non-intimidation/retaliation policy, which, in their words, has proven to
be effective to build a culture of compliance (Cabrini of Westchester, 2019). All communication
channels are open for the workers that wish to report non-compliant behavior. Both organizations
have training programs, but the LCCA one seems to be more preventive than the CoW because
their training is in two phases, the first phase is a deep initial orientation training, and every year
they have a refreshing training about compliance.
