The assignment below is based on Appendix 1 on pages 477 to 480 of your prescribed textbook
(Marnewick). Read the statement of Mrs Anne Smith contained therein and then draft the
following:

1. Mr Young Representative, who is Mrs Smith’s attorney of record, has briefed you. Mr
Representative has requested a written opinion from you in which you detail all the
potential claims arising from Mrs Smith’s statement. Mr Young Representative further
requires you to identify the pertinent legal principles and how they apply to the particular
facts and circumstances of the case in question. Provide the written opinion to Mr Young
Representative. Refer to pages 36 to 40 of the prescribed textbook as a starting point.
Your written opinion must be properly referenced and may not exceed 20 pages in
length.

appropriate course of action insofar as the panel beater and insurance company are
concerned is to institute an alternative to formal litigation. With reference to pages 54 to
