The history of natural law became very interesting at this point and also a bit
convoluted.




• In the fifth century, the Roman Empire was split into the Western Empire (centred
on Rome) and



• The Eastern Empire (centred in Constantinople today known as Istanbul).




• The Western Empire was destroyed by invading forces and, in the process books
by Greek

, • Roman philosophers were destroyed or lost




• But they were preserved in the Eastern Empire and, interestingly, in Africa.



• Augustine used the works of Plato and combined it with the teaching of Christ to
establish the philosophical basis for the new Christian religion.




• In the Eastern Roman Empire the Greek and Roman philosophers were also
studied.



• This had a philosophical influence on the codification of Roman law by Justinian.
When Constantinople fell to the Islamic forces those fleeing the occupation took




• The codification to Western Europe. And this provided the impetus for the
rediscovery of Roman law by medieval jurists.



• In Africa, the early Christian church had established various monasteries and the
African priests and bishops who inhabited them continued to study the Greek and
Roman philosophers.




• Greek works were also used by Islamic jurists and philosophers
