parties, with the capacity to contract, have a meeting of the minds and intend to create legal
relations. This means that both parties must have a common understanding of the essential
terms of the contract. Furthermore, if there is a mistake as to the identity of the subject
matter of the contract, the iustus error doctrine, which means "justifiable error," may apply.
