QUESTION 01

1.1 You are a paralegal advisor at a Paralegal Advice Centre in your community. Describe how you would
deal with EACH of the problems below. In your answer, you need to mention whom or which office you
would approach for assistance and provide a reason for your answer.

a. Mr Barnard has just turned 65 years and needs to retire. He is unhappy since an amount of
R10 000 will be deducted from his pension benefit because it is alleged that he stole a
company laptop.
ANSWER:
Mr. Barnard's Pension Deduction: As a paralegal advisor, I would advise Mr. Barnard to
approach the Human Resources department of his previous employer. Request a written
explanation for the pension deduction. If HR is uncooperative, consult a labour attorney.

b. After the matter has been resolved, the money was paid back into his bank account. The
bank refuses to let Mr. Barnard withdraw an amount of R50 000.
ANSWER:
Bank Account Issue: Mr. Barnard should contact his bank's customer service for an
explanation. If unsatisfactory, escalate to the bank's branch manager. If unresolved, contact the
bank's ombudsman or regulatory authority.

c. Mr Barnard would like to sell his old house and buy a bigger one in town.
ANSWER:
Selling and Buying Property: Engage a real estate agent to help sell the old house and find a
new one. Consult a conveyancing attorney for legal aspects of property transactions.
