, §1 Inleiding
Iedere Europese staat die de waarden van artikel 2 van het Verdrag betreffende de
Europese Unie (hierna: VEU) eerbiedigt en zich ertoe verbindt deze waarden uit te
dragen, kan verzoeken om lid te worden van de Europese Unie (hierna: de Unie). 1
Op dit moment zijn er acht staten die formeel de status van ‘kandidaat-lidstaat’
hebben gekregen van de Europese Raad, waarop de toetredingsonderhandelingen
gestart kunnen worden.2 Om toe te kunnen treden tot de Unie, moet aan een aantal
voorwaarden worden voldaan. In dit paper wordt onderzocht of de toetredingscriteria
de rule of law van artikel 2 VEU waarborgen. Dit leidt tot de volgende centrale vraag:
In hoeverre waarborgen de toetredingscriteria van artikel 49 VEU en de bijbehorende
Kopenhagen-criteria de vereisten die de Europese Commissie stelt aan de ‘rule of
law’ in het kader van artikel 2 VEU?
Om antwoord te geven op deze vraag, wordt in de tweede paragraaf omschreven
wat de voorwaarden zijn om toe te kunnen treden tot de Unie. In de derde paragraaf
wordt beschreven hoe deze toetreding doorwerkt in de nationale rechtsstelsels. In de
vierde paragraaf wordt beschreven welke vereisten de Europese Commissie stelt
aan de ‘rule of law’. Vervolgens wordt in de vijfde paragraaf antwoord gegeven op
bovengenoemde centrale vraag.
