a) Discuss the law that applies to unlawful detention in terms of section 59 of the
Criminal Procedure Act 51 of 1977, as amended. Provide relevant authority to

Law on Unlawful Detention in Terms of Section 59 of the Criminal Procedure Act.1
Section 59 of the Criminal Procedure Act2, as amended, governs the law on unlawful
detention in South Africa. This section stipulates the procedures to be followed when a
person is arrested without a warrant. Specifically, it requires that any person arrested
without a warrant must be brought before a magistrate within 48 hours, excluding
Sundays and public holidays, or as soon as reasonably possible.3
In the case of Syce and Another v Minister of Police 4, the Supreme Court of Appeal
(SCA) considered the lawfulness of Mr. Syce's detention under section 59. 5 Mr. Syce was
arrested on charges of drunken driving and detained at the Walmer Police Station. The
