committed. It is a reasonable belief based on facts or circumstances and is informed by a police officer's
training and experience. Reasonable suspicion is seen as more than a guess or hunch but less than
probable cause.
probable cause - ANSWERSis the logical belief, supported by facts and circumstances, that a crime has
been, is being, or will be committed.
Terry v. Ohio - ANSWERSAn officer with reasonable suspicion that the suspect has commited, is
committing or may be about to commit a crime, and that the suspect is armed and dangerous, may
conduct a 'stop and frisk' on a suspect without probable cause to arrest. Reasonable suspicion must be
based on "Specific and articulable facts" not just a hunch.
Brendlin v. California - ANSWERSSimilar to "Whren v. US", this case law covers that a lawful traffic stop is
an act of detention but also includes the passengers of the vehicle. No one in the car, driver or passenger
is free to depart without police permission.
Whren v. US - ANSWERSAn automobile is allowed to be reasonably stopped if officers have probable
cause to believe that a traffic violation has occurred even if the officer has no intent on traffic
enforcement. A traffic stop is also a form of detention with reasonable suspicion.
Pennsylvania v. Mimms - ANSWERSAn officer may order a driver out of an automobile after a lawfully
detained traffic stop under the justification of officers safety and / or to conduct a pat down to check for
weapons. Must meet the same criteria as Terry v. Ohio.
Maryland v Wilson - ANSWERSSimilar to "Pennsylvania v. Mimms", however aimed as passengers of
automobiles, officers can lawfully order passengers of a lawfully stopped automobile to exit and be
patted down. Must meet the same criteria as Terry v. Ohio.
