1.1 The Impact of Social Media on the Constitutional Right to Privacy
Privacy refers to an individual's right to keep their personal information,
communications, and activities from being exposed to others without consent. The right
to privacy is protected under Section 14 of the Constitution of South Africa, which
guarantees the right to privacy, including the privacy of communications, property, and
personal space.
Social media has dramatically affected this right. While platforms like Facebook,
Instagram, and Twitter offer opportunities for connection and self-expression, they also
expose personal data to public scrutiny. People's information, such as location, personal
preferences, and even private conversations, can easily be accessed or misused by
third parties. Once information is shared online, it is difficult to control its dissemination.
As a result, social media has blurred the lines of privacy, creating a delicate balance
between public sharing and the protection of personal information.
1.2 The Impact of Social Media on the Constitutional Right to Freedom of
Expression
Freedom of expression is the right to voice one's opinions, thoughts, and beliefs without
fear of government repression or censorship. This right is enshrined in Section 16 of
