Criminal cases and civil cases are two different bodies of law which creates our justice
system. Criminal cases happen when someone breaks a law or commits a criminal
offense, which typically results in jail time. Civil cases handle almost all other disputes
and typically aim for some sort of recovery.
A criminal case is filed by the government and is led by a prosecuting attorney. A civil
case is filed by a private party, typically an individual or corporation, against another
individual or corporation.
In a criminal case, a defendant is either acquitted or found guilty beyond a reasonable
doubt. It is the responsibility of the state or federal government to prove that the
defendant undoubtedly committed the crime. In a civil case , a plaintiff brings a lawsuit
against a defendant. The burden of proof falls on the plaintiff, who must prove that it is
more likely the defendant was responsible, that defendant is said to be liable than guilty.
In a criminal case the judge sentences a defendant who is found guilty but in a civil
case, a defendant who is found liable for an act of wrongdoing can be ordered by the
jury to pay for the damages.
