a) What should Mr. Tom do to remove the fake profile from the social media platform? (8)
ANSWER:
Mr. Tom, upon discovering a fake profile impersonating him on a social media platform, should
take immediate steps to have it removed. First, he should report the fake profile directly to the
social media platform. Most platforms have a specific reporting process for impersonation,
where users can notify the platform about accounts falsely representing them. Mr. Tom will
need to provide evidence of his identity and that of his business, Pharmcare (Pty) Ltd, to
substantiate his claim. This evidence could include copies of his identification documents,
business registration, or any other documentation proving his identity and ownership of the
business.
If the social media platform fails to act swiftly, Mr. Tom could send a formal cease and desist
letter. This letter should clearly state that the profile is defamatory, infringing on his rights, and
