1.1 Discuss the following statement:


“Legal ethics can be understood in a wide and a narrow sense.” (5)


The wide sense relates to the general relationship between law and morals and includes
the study of the debate between positivism and natural law and between liberalism
and communitarianism. The question here is whether the law can be used to decide
moral issues (abortion). The narrow sense relates to: ethical standards of professional
conduct which applies in the law. Shows how the lawyer should behave to be a
good, decent and proper lawyer.1




1.2 Read the following scenario and answer the questions that follow:


Jimmy has just completed his LLB degree, and he is now working as a candidate
attorney at a big law firm in Pretoria. One Saturday morning, Jimmy and his mother,
who is a nurse, discuss their respective professions and how they are being
regulated. Jimmy tells his mother that he (Jimmy), as a candidate attorney, is
suspicious of codes of ethics. Jimmy’s younger sister, Annie, who is a first-year
medical student, asks him what a professional code is.


(a) Explain what a professional code is and list any three general aims of a code
of legal ethics. (5)


A professional code of ethics proposes a compliance of ethical values to provide
practitioners with a framework of the ethical practice of law – code seeks to:2

• Protect the public against improper conduct or incompetence.
