The Labour Relations Act (LRA) of South Africa establishes

the workplace. These councils play a crucial role in fostering
industrial peace and resolving labor disputes. One of their primary
functions is to conclude and enforce collective agreements on
behalf of their members. Here, we will discuss the binding effect
of these collective agreements and the extent to which they can be
extended to trade unions and employers who are not part of the
bargaining council.
Binding Effect of Collective Agreements
Collective agreements concluded by a bargaining council are
binding on the parties that are members of the council. According
to Section 23 of the LRA:
1. Members of the Bargaining Council: A collective
agreement binds the parties to the agreement, including:
o Trade unions that are part of the bargaining council.
o Employers who are members of the employers'
organization that is part of the bargaining council.
