1. Standing
- Threshold requirement that a litigant must satisfy before they can ask court to engage with the substance
of their case
- Right of x to approach court for relief
Concept of standing
- Refers to a right to be heard
- No judicial process can proceed unless standing established
To establish standing, claimant must
- Show he has legal capacity
- Must show an interest that is sufficient to entitle him to a hearing
o Must justify why he should be entitled to pursue claim against defendant
