COMPARATIVE LAW 4/
MICRO-(LEGAL)
COMPARISON
Prof Dr Cosmin Cercel
Er is altijd een inbalance between de vss lagen van onze legal world (= constitution, legislative, rechtspraak,…). One legal order is dus op
one legal order in de praktijk, maar enkel in the law in books. The law in books is a representation of reality, and this reality can differ. Ros
stapte hij hiervan weg. Volgens Roscoe Pound moeten we de huidige doctrine altijd in vraag durven stellen. De doctrine influences the re
doctrine) and law in action. The law in books is gwn een abstracted representation of law (in action).

▪ law and/or as language
▪ sources of law
➢the actual comparison
We bekijken how do we produce the knowledge of foreign law and the foreigner zelf.
