- Unlawfulness: agreement to commit a crime (Ngobese) (s 18(2)(a) of the
Riotous Assemblies Act)
- Causation: formally defined so not required (Ngobese; Snyman)
- Capacity: presumed as per s78(1A) CPA
- Fault: intention (Ngobese)
