pharmacy degree or by equivalent service by branch in US armed forces

o Enact rules for CE requirements and approve CE programs
o Have the power to investigate alleged violations of provision

,o Can develop procedures for pilot experiments at < 3 pharmacies for < 2 years. Have to report findings
to house/senate on Dec. 1.
o Licensed drug outlets can sell/distribute non-rx drugs w/o supervision of Rph.

Regarding meds, drugs, devices, and other materials:

-Regulation of sale/dispensing of meds and the right to seize it if found to be detrimental (then have

procedures for compounding/dispensing

- Issue registration certificates/licenses to drug outlets

Unlawful practice: starting here is fixed

-No unlicensed RPh can practice pharmacy except MDs, dentists, etc that are licensed under the laws of
the state in their scope of practice.
-Criminal action may be made by board against any unlawful engagement of the practice of pharmacy.

Qualifications of licensure: applicants for licensure by exam shall:

-Attained the age of majority (18+ y.o.)
-Cannot have past felony conviction related to practice of pharmacy
-Cannot have suspension, revocation, or restriction of a license to practice health-related regulated
profession with past 5 yrs.
-Graduated and received professional undergraduate degree from school approved by board or foreign-
trained applicants successfully past equivalency test. -May have personal interview to demonstrate oral
comprehension of English.
-Completed internship program or demonstrated pharmacy practice experience.
-Successfully passed board exam. Exams administered at least 2x/year.
-Board can endorse an applicant who is licensed under law of another state, but equal to those of this
state
-Licensing standards made by board should be fair/reasonable and should not limit # of licensees
-If licensee has principal place of business, license should be prominently displayed there.

Pharmacy techs; qualifications for registration:

-Have to be registered by the board
-Must not have engaged in acts that affect the ability to practice as pharmacy tech
-Paid fee

Pharmacy techs; nondiscretionary tasks/supervision:

-Can perform packaging/other mandatory tasks only while assisting and under supervision of RPh
-Pharmacist has to be on duty
-Cannot make any professional judgment that requires a RPh
-Board can adopt rules to specify pharmacy tech tasks
-Must submit an application for registration with Board before is a pharmacy tech. Pending approval a

, tech can work up to 30 days or until make decision
-Pharmacist on duty directly responsible for tech. -Pharmacist must be on premise and must verify rx
before given to patient.

Renewal of licenses and reinstatement:

Renewal of licenses:
-Pharmacist/pharmacy tech must renew license every 2 years (biennially) by date established by director
of office - board renews license
Reinstatement:
-Board may renew a lapsed license upon payment of required fee and the late renewal penalty
-Have CEs and other requirements done
-Board should not require payment of renewal fees during years which license was lapsed

-Board can refuse to issue/renew or suspend/revoke/restrict the license if:
- There is unprofessional conduct which is defined by rules/regulations of board
-Incapacity of a nature that prevents RPh from practicing pharmacy with reasonable skill, competence,
and safety to public
-Fraud/intentional misrepresentation when issued/renewed license
-Engaging/aiding and abetting a person to practice pharmacy w/o a license
-Found by the board to be in violation of any provisions of rules/regs

Penalties and reinstatement:

After notice/hearing, if have grounds for discipline, board may impose:
Suspension/revocation
Restriction of licensee to do certain acts
Placed under supervision by board under certain conditions
Perform 100 hours of community service
CE training or course
Administration penalty
