a) Civil litigation cannot be conducted without considering the values contained in section
36 of the Constitution. The Bill of Rights (Chapter 2 of the Constitution) applies to all
law, including the law of civil procedure, as provided for in section 8 of the Constitution,
as several rights contained in the Bill of Rights is directly related to the law of civil
procedure, e. g. equality before the law (section 9); the right to access to the courts
(section 34).
