Art. 3:34 BW
Rechtshandeling onder invloed van een geestelijke stoornis = vernietigbaar.
1. stoornis van de geest:
blijvend; of
tijdelijk
2. causaal verband tussen de stoornis en de rh:
stoornis staat redelijke waardering van de bij de handeling betrokken belangen in de weg; of
verklaring is gedaan onder invloed van de stoornis.
Let op: eenzijdige rechtshandeling = nietig, art. 3:34 lid 2 BW!

2. onjuiste voorstelling van zaken (dwaling)
3. casuaal verband tussen deze voorstelling en sluiten ovk
4. aanwezigheid grond lid 1 sub a t/m c
a. dwaling te wijten aan onjuiste inlichting wederpartij
b. ongeoorloofd zwijgen wederpartij
c. wederzijdse dwaling
5. kenbaarheid in geval dwaling sub a of c
6. dwaling geen toekomstige omstandigheid
7. dwaling komt niet voor rekening dwalende op grond van
a. aard van de overeenkomst
b. omstandigheden van het geval
c. de verkeersopvatting:
- verkopersdwaling (Kantharos/Van Stevensweert); of
- onderzoeksplicht dwalende geschonden, tenzij wederpartij onjuiste inlichting geeft
mededelingsplicht schendt.
