Case study 2: Wellings NHS Trust, Ward 3B
The Welling NHS trust, ward 3B is a female surgical ward. The manager of the ward is Amina
Patel she is supported by nurses, healthcare assistants and nursing associates. The service user
in this case study is Lizzy D. Lizzy had a problem with her left hand. In this case study you can
see implication and failure of duty of care. Lizzy complains about her arm when her husband
comes to visit. In this case study we can see failure of duty of care. Abuse is also seen in this
case study.
Duty of care
Duty of care is a moral or legal obligation to ensure the safety or wellbeing of others (Google
2019). All professionals have a duty of care. It is important that professionals follow their duty
of care if a professional doesn’t it could lead to a service user passing away or the professional
being fired. For example, if someone injured themselves and they needed medical assistance
and you don’t have any knowledge of first aid or medical, but you still did it, you're not doing
your duty of care because you have no knowledge of what you are being pressured to do.
Professional must explain to the service user how to complain. (slide show 2019).
Duty of care helps the health care setting to be a healthy and safe environment for people who
need professional help. It also helps the professionals to do their job from the best that they
can, and this helps them to do their duty of care. If a professional doesn’t do their duty of care,
it can lead to someone getting hurt or a service user may get neglected.
It is also a professional's duty of care to use the 6 C’s. The 6 C’s are Care, Compassion,
competence, communication, courage and commitment. Also being observant and asking if the
service user might want or need anything is also the professional doing their duty of care. It is
very important that a professional is doing their duty of care and that they're only going their
duty of care. If they do something that they are not qualified for then they have failed to do
their duty of care and might get put into prison or could even get fired.
Significance of Duty of Care
The strengths for duty of care is professionals do their work and if they are doing their work
then service users are safe and healthy. It also shows the high-quality care. Every professional
has one job, so everything is in order. A cleaner has a duty of care, for example, if the cleaner
mops the floor and doesn’t put the sign that the floors are wet then the cleaner isn't doing their
duty of care and could get sacked. Because a service user or anyone could fall and injure
themselves. They haven't put the sign which doesn’t warn people that the floor is wet.
However, if they put the sign then people are aware that the floor is wet and if something does
happen to someone they can’t sue them because they had a sign that shows the floor was wet
and that it was their fault for not being careful. By putting the sign on the floor, it will have a big
impact.

,The weaknesses of duty of care are the professional might not be able to help the service user
or the professional might harm the service user. Or another reason could be that the
professional doesn’t know how to use a technology which is needed during the time for the
service user. Small things like these could lead to the service user being ill or they could pass
away. Being pressured into doing something that you don’t know is a failure of duty of care. If
you cannot take care of a service user in any way it is neglect and neglect is a federal crime.
It is important that we promote safety in duty of care because as I said in the first paragraph if
the cleaner doesn’t put the wet floor sign on the floor then they are not doing their duty of care
and Someone could injure themselves. If someone complains about this then they are safe
promoting because they are showing that there is something dangerous and needs to be dealt
with. The benefits of Safe promoting can help improve the community, improves the service
etc. The disadvantages of safe promoting are that it could have a bad reputation, also some
service users could sue you and take a lot of your money.
Case study
The strengths of the duty of care in the case study is the nurse being observant and realizing
that Lizzy’s hand was discolored and swollen, so the nurse had done her duty of care by being
observant. The Manager of the ward had also questioned the service user because she had
been worried about the service user however Lizzy does not want to talk, and we know this
because when the manager had asked her, she moved her head the side. As the ward manager
she has also fulfilled her duty of care by asking the professional questions. The manager also
spoke to the nurse about her not recording the medication down. Had Lizzy felt comfortable to
talk, them doing their duty of care would have kept them safe.
The weaknesses of duty of care in the case study are the nurse not recording the medication
she had given to Lizzy and she also did record the signs of abuse. If the nurse had recorded the
sign, then Lizzy would have been safe in the health care setting. The nurse had also been
spoken by the manager about not recording the medication down, however the manager
herself forgot to record the medication down herself which is failure of duty of care. This
weakness highlights that implications such as being busy are a flaw in promoting safety.
Another weakness of duty of care in the case study is the keypad of the door is broken which
means anyone can leave in and anyone can come in this is a weakness because the service
users are in danger if they keep the keypad broken due to they won't know who comes in to
the health care setting and may harm the service users. Some service users may leave the
hospital without anyone knowing this is also a hazard because they may get hurt outside. This
shows a weakness as if someone fails to do their duty of care, it can impact how well others do
their duty of care.
The 6 C’s
Duty of care is the safety and the wellbeing of others. It is important that you do your duty of
care, for example, if a service user tells you something confidential and it shows that they are in

, danger then you would tell someone to make sure that the service user is safe. You cannot
promise the service user that you won't tell anyone because if they are not safe as your duty of
care you must tell someone. The service user trusts the professional with this secret and must
keep it to themselves unless the professional thinks that the services user is in harm or going to
hurt themselves. If a professional does their duty of care and takes good care of the service
user, then the service user would trust them and have a bond with them so they would talk to
the professionals about stuff this is called a discloser. Discloser can only happen when there is a
bond with the professional and the service user. To gain trust and have a bond with the service
user you must speak to the service user and ask them if they need anything and offer them
stuff. By doing these things you gain their trust and they will see that you care about them
which will get the service user to speak. The bond that the professional and the service user
have must be kept professional because if it doesn’t then the professional might not do his/her
duty of care.
Care is a part of duty of care because all professionals must do their duty of care. The service
user expects the professional to give all the care they possibly can. If the care can't be given its
neglect. Care is looking out for the service user and given them the needs that they need. If the
professional does not give all the care, then the service user must report this to manager or the
ombudsman. Care improves the community.
Compassion is how care is shown and given by kindness, empathy and dignity. It can show how
the professional is caring for you. If the service user gets all the support and the needs from the
professional, then they might have a professional bond and get disclosure from the service
user. It is important to show compassion it helps understand the individual's situation and to
help the individual to make better life choices.
Competence means knowing what the patients' health and social needs are. It is also important
that the professional have all the knowledge of how to work things out, for example,
technology. It is important that they know how to use technology because in a health care
setting technology is being used a lot and will be needed.
Communication is a successful way of understanding the service user's health and needs. It's
also successful in getting disclosure by having a professional bond with the service user and
meeting all their needs. Communication Is important because if a professional does not
understand the service user then they will have a problem with the needs that the service user
may need.
Courage helps professionals to do the right thing for the service user. If professional thinks that
something is wrong, then they should be able to have the courage and speak up. By having the
courage to say what we are thinking it helps the community to understand that we need to
speak up and say what we feel. If a professional think that the service user is being abused, they
should have the courage to speak to the service user or to someone that has more power than
them.
