o If intoxication has any effect on liability it is because it explains why the accused lacked
mens rea. If mens rea is present (even drunken mens rea) the accused is still guilty
o A defendant is not guilty if he forms an intention as a result of involuntary intoxication and
that intention is one he would not normally form while sober. R v Sheehan [1995]
