P3 Explain how one piece of legislation one policy and one code of practice that could
be applied to planning support of individual,
In this task I would be defining legislations, policies, codes of practices and how it can be
applied to planning support for individuals in health care.
Legislation: legislation can be defined as the process of making laws, it also refers to the
law that the parliament makes, these laws reflect and state rights of organisations groups
and individuals.
All health care settings should understand the importance of making sure they adhere to the
laws, to avoid poor practice in the health setting and to ensure everyone is clear about their
rights and responsibilities in a caring environment.
Example of legislation in a health care setting is :
Race relation ( Amendment) Act 2000:
This Act protects against racial equality and ensures that no one is discriminated on on the
terms or grounds of their race, it also helps promote good relations between people of
different ethnic background, it was introduced into the society to remove discrimination and
any possibility of discrimination and to actively promote racial equality in the society.
In a health care setting it is very important and vital that organisations have a legal
responsibility to ensure that all procedures and policies are put into place to make sure that
organisations are equal racially, it is also really important in a health setting for all health
professionals to be culturally competent and value diversity and promote tolerance and
understanding.
An example of how it can be applied to planning support for an individual, in reference to
Ravi’s case in the care home, as English is not her first language and Hindu is, she might
not be able to communicate like the others in English but that does not mean she should be
discriminated against as she does not speak English like others, she should be asked
frequently for her needs and wants and care workers should not assume that maybe
because of her culture she might not be interested in some activities.
Ravi should also have an interpreter, if no one is able to understand her language and she is
unable to communicate her feelings in English, if there is no interpreter to help with Ravi
then that means she is been discriminated against on the basis of her language as no one is
interested in the fact that there are unable to understand her .and Ravi by herself is unable
to communicate to anyone in the care home about her needs.
In situations like this, there should be an interpreter or an advocate to make sure language is
not a barrier or grounds that she should be discriminated against.
POLICIES: Policies can be defined as actions adopted and proposed by an organisation or
individual, policies are generally adopted by government bodies within an organisation.
Managers and individuals who hold high positions in health care settings have a
responsibility to support and guide their employees to ensure that they observe equality,
diversity and rights in the health setting,
An Example of policies in the health setting include :
Confidentiality :
Confidentiality is the state of keeping situations and action private.
Confidentiality is the heart of what health and social care professionals do every organisation
in a health and social care sector must have a confidentiality policy,

Confidentiality in a health setting must be actively adhered to protect an individual status
from being known to the public and also to protect the service user in the health care setting
if information about a service user is known to the public it might pose as a health and
security hazard as information about the service user might be known to an unauthorised
person and it will be used against the service user and the service user might be at the risk
of danger.
Also if information about a service user is known to the public it might make the service user
be subjected to humiliation, loss of dignity and stigma.
Confidentiality can be applied in planning support of an individual, in reference to one of my
case study, Karen’s personal information and medical history should not be revealed to the
public and it should also be kept properly and safely in the care home where no
unauthorised person can see it, In a situation where Karen’s medical history or personal
information is known to the public, it might pose as a dangerous risk to her life as individuals
might want to use a certain illness of her to use against her or harm her with.
Furthermore, if there is a breach of confidentiality it can also subject Karen to a lifetime of
humiliation, loss of dignity and also stigma. she would feel discriminated on and will not be
happy.
It is important that Karen’s care home make sure documents are properly and safely kept
and that the care workers in the care home should be properly trained on the importance
and dangers of confidentiality.
CODE OF PRACTICE :
Codes of Practice are a set of written rules that explain how individuals working in a
particular profession should behave.
Codes of practice are put in place or order to guide and inform individuals in a professional
setting of their rights and most importantly the responsibilities of their professions.
In a health care setting, all health professionals are expected to undertake an induction
period which includes the right training leading to relevant qualifications, this would enable
them to perform their roles efficiently and professionally.
An example of a code of practice in a health setting is :
General Social Care Council Codes of practice :
This code of practice applies to England, Scotland, Wales and Northern Ireland, All four
bodies were set up to regular the social care profession,
They are responsible for increasing the protection of people who are receiving care in care
homes and also making sure that carers and the general public put in the codes of practice
and behaviours that meet their professional occupation codes of conduct.
The codes of practice are for everyone working within the social care sector and it also
includes information on protecting the rights and promoting the interests of service users and
care workers in the health care setting, it is also mostly based on increasing the quality of
service given in a health care setting.
General social care council code can be applied in planning the support of an individual in
reference to my case study Ravi it will be applied by ensuring that service users and service
givers are aware of their rights in the care home she resides at. Ravi should be aware of her
rights and also the care workers in the care home should also be aware of their rights and
responsibilities to the service user as it is their profession.
