LEGAL ISSUES
Data protection act
The data protection act is a law that requires organisations to protect the
data they collect form their customers in order for their information to not
be used for any malicious purposes. The information that businesses keep
must be:
Obtained fairly- data being collected secretly or not being clear on how
the information is used. For example, Bullworth must be clear on how they
are going to use the parents physical address information. This practice
makes Bullworth follow the data protection act because if they where not
stating how the information was used, Bullworth has violated the right “to
be informed of the use to which their personal data is to be put”. this
right is under the data protection act. Therefore they will be breaking the
data protection act. Bullworth ensures that they follow this law by
providing letters to parents that indicate how their information will be
used. For example, for all of Bullworths school trips, the teacher is
obligated to provide a confirmation slip for the parents to sign. The slip
always indicates that the parents signature will be used to confirm that
the parent has allowed the student to go on the school trip.
Used for the purpose it had- for example, Bullworth cannot give parents
physical address to other schools if the parents are unaware.
This shows that Bullworth is following the data protection act because as
the data protection act states “Every data controller or data processor
shall ensure that personal data is collected for explicit, specified and
legitimate purposes and not further processed in a manner incompatible
with those purposes”. If Bullworth collected the data for other reasons,
then they would be breaking the data protection act. Bullworth ensures
that they follow this law by expecting their staff members to handle
information with integrity. If they get caught misusing information then
there will be very heavy consequences.
Must be up-to-date and accurate- for example, Bullworth ensures that
parents phone numbers are up to date by providing students with diaries
every school term. This will force parents to update their cell phone
numbers every term.
This practice indicates that Bullworth is following the data protection act
because as the data protection act states “Every data controller or data
processor shall ensure that personal data is accurate and, where
necessary, kept up to date, with every reasonable step being taken to
ensure that any inaccurate personal data is erased or rectified without
delay” they followed this law by making sure that the parent information
is up to date. Bullworth ensures that they follow this law by ensuring that
information collected is usually updated on a regular basis just like how
the school diaries are renewed every term.

not allow parents to change any information that may be incorrect like
house addresses or banking information.

a 10-year prison sentence.
Freedom of information act
This law allows individuals and organisations to obtain any information
that is held by a public authourity. This can be governments etc. Bullworth
school has the right to access public information that the government
holds. For example, Bullworth can get information about weather their
employees or individuals they want to hire have a criminal record. They
can do this by obtaining their certificate of good conduct of the individual
for a fee of 300 kes. Bullworth can obtain this data in the DAC(Directorate
of Criminal Investigations) office. The government is not allowed to stop
companies or individuals from getting this information. Therefore
Bullworth have used their rights to access public information.
Computer missuse act
This law consists of not allowing organisataions or individuals to use
computers for malicious reasons like hacking into other peoples devices,
missusuing software (eg, pirating software or selling pirated software) or
hirering someone to gain access to another individuals confidential
information.
This law does not allow organisations or individuals to gain:
unauthorised access to a computer material- for example, Bullworth
students are not allowed to hack into the Bullworth administrator accounts
in the computerlabs.
This shows that the Bullworth is violating the computer missuses act
because according to the computer misuse act “A person who causes,
whether temporarily or permanently, a computer system to perform a
function, by infringing security measures, with intent to gain access, and
knowing such access is unauthorised, commits an offence and is liable on
conviction, to a fine not exceeding five million shillings or to imprisonment
for a term not exceeding three years, or to both.” Bullworth ensures they
follow this by taking security measures to ensure that students and staff
members dot get access to computers like setting strong computer
passwords and not allowing staff members to tell students the
administrator passwords. They also put important files like report cards in
a secure server that students cannot access without the administrator
password.
Unauthorised access to computer systems with intent to commit another
offence- for example, teaching staff members are not allowed to access
parents bank account information. They are bound to use this information
for malicious purposes like selling the information or stealing the money.
