Sexual Offences Part 2
Why are children treated differently
Children under 13 vs Children 13-16
Offences against children under the age of 13 are strict liability offences – a child under 13’s consent is irrelevant to
these offences
There is no defence, even if the defendant reasonably believed that the victim was over 13
If the victim is between 13 and 16, there is a defence if the defendant reasonably believes that the victim is over the age
of 16
What if the defendant is a child?
Sections 9-12 apply to offenders aged over 18
HOWEVER – s13 includes child defendants – “A person under 18 commits an offence if he does anything which would be
an offence under any of sections 9 to 12 if he were aged 18.”
