Robbery is defined under section 8 of the Theft Act 1968:




“A person is guilty of robbery if he
steals, and immediately before or at
the time of doing so, and in order to
do so, he uses force on any person or
puts or seeks to put any person in fear
of being then and there subjected to


Robbery is therefore a THEFT which is aggravated by the USE OR THREAT OF
FORCE.


The elements that must be proven for robbery are:

 Completed Theft
Topic 5 :
 Use of force or putting, or seeking to put, any person in fear of force -> which
must be used immediately before or at the time of the theft and in order to steal
 Mens rea for theft (dishonesty and intent to permanently deprive)

Property Offences
 Intent or subjective recklessness as to the use of force to steal
