outlining the 7 areas of duty of care and relating them to an adult and child case
study.

Duty of care is when you have a legal obligation to safeguard individuals. It’s
important that professionals have a duty of care to their patients because it’s a
practitioner’s authority to remain professional and promote welfare, safety and
wellbeing. Everyone is entitled to their own person-centred care to meet their needs.
To perform a good duty of care, you must always look in the best interests of those
in your care and have to keep up to date with their training. A background check
(DBS CHECK) is essential to ensure that someone is not barred from working with
vulnerable adults and children.

In the Zebra Ward case study, it is clear that the staff have not provided a good duty
of care, as it’s their job and obligation to protect children in this case because in the
first paragraph, they have failed to protect the children’s wellbeing and prevent harm
as they are not upholding the rights of the children, and the doctor seems to be in a
rush and forgets to record her opinions which is important because any small details
can later be used as evidence to fix the puzzle. It’s a service users rights to have
choice, dignity and right to not be treated badly. In Merryvale the patients aren’t
being treated fairly because they have experienced discrimination for being in a
same-sex relationship. There is also understaffed which creates institutional abuse
because they haven’t done person-centred care, for the woman who has developed
bruises on her neck should have a body chart as this is a policy. This links to The
Equality Act 2010 the purpose of this is to assure no one is experiencing
discrimination and everyone is being treated equally regardless of their race, sex or
religion.

7 areas of duty of care

Promoting effective communication and relation- Should be multi-agency working, so
there is good partnership between everyone, and the service users are supplied with
a wide selection of assistance. This passes on reports to keep up to date and
creates solid working bonds in the setting. This will leave everybody fulfilled.

Promoting anti discriminatory practise- This seeks to neutralise the rejecting
outcomes of injustice on service users, to tackle unfairness in all its layouts. You
shouldn’t participate in anything to do with discrimination.

Maintaining confidentiality of information- This is so you don’t breach out any
personal information, every document must remain confidential and put in a safe
place. Outside of work you mustn’t discuss any a service users’ issues, to anyone
who isn’t involved.

,Rights to dignity, independence, empowerment- You should let people have choice,
and always include them in decision making them feel entitled in their personal care.

Acknowledging individuals’ beliefs and identity- This is understanding individuals’
peculiar philosophies and character and being mindful to their beliefs, also being
mindful of working with a variety of different people. You shouldn’t pressure a service
user to do/take something that they can’t due to their beliefs.

Protecting individuals from abuse- You should have good training and set policies
and procedures on guarding individuals from harm. You should also give power to
them by reassuring them to produce their personal judgements and supply instructed
permission. Avoid the chances of violence or destruction, also prevent it from
resulting.

Providing individualised care- The service user should have a care plan, and there
should be a person-centred approach. The care should be made specifically for them
and they should be your main priority when working with them. You should also
investigate their selections and elected desires.

The aspects of duty of care are;

Legal obligation to protect wellbeing and prevent harm- Is to safeguard
individuals and always act in the finest enjoyment of the individual and other people
that may possibly be involved in your performances. This is so you act professionally
in work, different to how you may act at home.

Upholding the rights and promoting the interests of individuals experiencing
abuse or neglect- This is to stick up for service users’ privileges to be in command
of their lives to be praised for who they are.

Protecting health, safety and wellbeing- You must recognise that you are working
with vulnerable patients, so therefore it is your obligation to play the role to safeguard
the service user from any harm or being treated unfairly.

Ensuring safe practice- You must follow and abide by the polices placed in your
workplace, you must also point out hazards that could be harmful to you and the
service user and find ways to prevent it. You should also work in a clean
environment; you could do this by sterilizing all equipment and making sure
everywhere is clean and tidy.

Balancing individual rights with risks- A great quantity of individuals worries
about disengaging their liberty, which may produce issues with the people around
them who care for them who could perhaps distinguish the individual can’t handle
living unsupported. When working in a multi-ethnic environment, we must
understand that people have different beliefs and the service users have the choice

, and the right to receive or ignore any medication or any procedures suggested to
them.

Protecting Health and Safety

There could be possible effects of cross-contamination in Merryvale, where the
residents haven’t had a bath or shower this can also cause skin conditions. Safe
practice hasn’t been met when she didn’t record institutional abuse. In Zebra Ward
the doctor forgot to record her opinion has created a risk for the children because
this could’ve been used for later evidence; therefore, she has failed to safeguard and
protect the children’s health. There were no safeguarding procedures put in place at
all in Merryvale, there is emotional abuse where the two females have experienced
discrimination from one member of staff, this can mentally affect them and lead to
anxiety and depression, cause suicidal ideas and self-harm issues and how they
outlook themselves. In the Zebra Ward case study, when the doctor is unconvinced
they are making assumptions and it is very important you don’t make assumptions
because you may be wrong and this could cause complications, when he also fails to
record his observations they have not done code of conduct which was for them to
get information down, therefore, they have failed to protect the wellbeing of the
children. If the doctor forgets to take note of what they have given the children,
another doctor could possibly come in and prescribe the same medicine to the child
and this could lead to an overdose or could give them short-term or long-term health
issues.

Balancing Individual Rights

Code of conduct is important in the Nursing midwifery Council because this portrays
how you should behave professionally in working environments. The implications of
this is it exhibits the ethics the company desires to cultivate in overseers and in staff
and that being the case, shapes accurate mannerisms. This could be breached if
there are signs of abuse and performances of brutality, this will affect the service
users because there is a mild risk of destructiveness and have a heavy negative
impact on their health hence why you have to balance their individual rights. In
Merryvale Residence and Zebra Ward there should be put in safeguarding interests
in place to create a person-centred care planning. The implications of undignified
care are; it could make the patient have low self-esteem because they may feel that
no one cares for them and that they are a burden unto everyone surrounded by
them. Every service provider should be adhering to a code of conduct as its their
duty of care, along with be upholding service users duty of care and following
policies and procedures, the positive effects of these are the service users will be
pleased and the setting will be joyful.
