In this assignment I am required to create a booklet that will be delivered
to new interns. It will cover the legal and ethical issues associated with
the use of business information.

Legal Issues
Legal issues are concerns that relate to the law and impact the law in a
specific way, these issues usually affect the law negatively.

The Data Protection Act (1998)
Many businesses use and store information about people. It is compulsory
that businesses adhere to the Data Protection Act because it protects the
information held about people from being misused. Marks and Spencer
store information about their customers, employees and other businesses
they work with on a database.The information stored must be:
 Used only for the purposes stated during collection
 Not kept for longer than necessary
 Adequate, relevant and not excessive in relation to the intended use
 Protected from transfer to an area outside the European Economic
Area (EEA) unless adequate protection exists for that data in the
area.
 Obtained fairly and lawfully



How Marks and Spencer comply with these principles
Used only for the purposes stated during collection
Marks and Spencer must be clear about why they are collecting personal
data and what they intend to do with it. They’re not allowed to use the
information for anything that the customer hasn’t signed up for. For
example if a customer signs up for a Marks and Spencerloyalty card there
would be a box which can be ticked if the customer doesn’t want to
receive mail or emails. Therefore Marks and Spencerneed to respect the
customer’s choice and not send them anything.
Not kept for longer than necessary
Marks and Spencershould not keep customers data any longer than the
period of time they require it for. It should be used within the amount of
time that the customer allowed it for. For example, if a customer entered
