Feminism Jurisprudence

Feminist jurisprudence is fundamental to the aspects of women’s rights.1 It

concerns the experiences and oppressions of women.2 Accordingly, Patricia Smith

has commented that the mutual objective of all feminists is the opposition of the legal

system which not only reflects, but also reinforces a male perspective.3 However,

feminist jurisprudence is not just a single theory.4 On the contrary, Katherine Barlett

defines it as a collection of different movements and philosophies which all have the

common goal of achieving equality for women with men. The differences among

feminists’ schools of thought is the way in which they attempt to solve the problem of

patriarchy.5 Therefore, Cain offers a useful categorisation of feminists into four schools

of thought such as liberal, radical, cultural and post-modern feminists, based on the

various ways in which each school approaches equality.6

This essay explores the advantages and drawbacks of cultural feminism. The

reason why this paper undertakes this school of thought topic is because it is the

closest vision of feminism to which one could agree upon. Then, the remaining part of

this paper will go on to discuss the TED talk which requires one to examine whether

gender equality is beneficial to all parties.

Unlike other types of feminists, cultural feminists acknowledge and embrace

the differences between women and men.7 They celebrate the distinctive norm of
