This essay will aim to apply the different legal framework in the United Kingdom and
European laws as applied in three different scenarios. These three scenarios are typical
situation between organisations, customers, stakeholders and company Acts.
The case between Beauty & Health Ltd and Karen is under commercial law, according to
Adams (2018) the fundamental principle of Commercial Law is that parties entering into
commercial transactions are of equal bargaining power, this means freedom of contract.
Under this law it is expected that the expectations of the consumers meets the value
proposition and information being told by the manufacturers, which in case the product was
not offering the anticipated outcome from the advertisement. Therefore Karen can sue the
manufacturers under the consumer law because it is more paternalistic and protectionist,
although but not under breach of contract. According to MacIntyre (2018), breach of contract
could only occur when there is a written or verbal agreement between parties, therefore
failure to meet the terms and conditions could b be seen as breach of contract. In respect of
the case study it is imperative that Karen did not have any contract with Beauty &Health Ltd
when buying the hair pills. The first part of the essay highlights significant of Beauty &
Health Ltd case with Karen and the next paragraph.
According to the Consumer Right Act 2015 gives the consumer to the opportunity depending
on the statutory right which enable them to reject, have their goods repaired and have the
wright for it to be replaced (Adam, 2018). Therefore in the case of Karen the reputation of the
products fails to meet the expectation of the consumer and this could be considered as breach
of Sale of Good Act which is under the consumer right act, this implies that products sold to
the consumers will need to meet the quality standard with satisfactory outcomes. According
to Pearson (2016) there are certain expectations for goods and services offered by
organisation and these includes; fit for the purpose, as described, satisfactory quality. These
elements were lacking in the context of Beauty & Health Ltd products, therefore any claimant
will be under the Consumer Right Act. According to MacIntyre (2018), identifying the legal
trading entity of the business will guide on the legal proceedings as the Consumer Act Right
2015will be enforced against the entity of the organisation. Although in a situation that the
organisation is operating outside the United Kingdom then the process will be different
because of the legal framework.
