Unit 1 - P4 – Outline the meaning and types of alternative dispute resolution (ADR)

Unit 1 - M2 - Compare and contrast alternative dispute resolution (ADR) with dispute solving
in a court

INTRODUCTION

In this assignment I’m going to demonstrate the alternative way to resolve disputes for civil
cases in a procedure called Alternative Dispute Resolution In which separates significant
number of civil cases from the court system. Moreover Alternative Dispute Resolution settles
civil cases in different departments. These include negotiation, mediation, conciliation,
arbitration and Tribunals. Furthermore these type of ADR focuses on different matter of law
regarding their categories in civil law and the significance of the dispute.

nowadays, Alternative Dispute Resolution has become popular to deal with the less significant
civil cases in order to reduce the cost of the court system as well as encouraging people to
resolve their issues in an informal, less time consuming procedure in which could benefit them
in a financial perspective as well as considering that some cases might stigmatize someone or a
company’s reputation. It is therefore essential for the society to have such a system for
people’s dispute.

In addition, ADR is massively different from court trial as it does not require people to go to the
court and face the judge, jury and lawyers and as a result it reduces its stress and mental side of
it in which gives people an opportunity to resolve their issues in such an informal way by
debating and giving evidence. Furthermore ADR does not have the costs of litigation therefore
it’s a great way to resolve issues as it is financially beneficial for both the government and the
people. Additionally ADR procedure does not require any formal place in order to resolve
disputes except tribunals.
