Registration of Title

The purpose of this system is to provide a ‘one-stop shop’ for all interests on the land
Two things are registered:
1. The title to the property (owner = registered proprietor)
2. Majority interests of the property
The system operates on three principles:
1. Mirror Principle
Reflects interests and titles affecting the land
2. Curtain Principle
Unnecessary interests are kept of the register
3. Insurance Principle
Compensation is rewarded for any mistakes on the register
Register grants the applicant with one of 4 titles:
1. Absolute title
2. Qualified title
3. Possessory title
4. Good Leasehold title
The latter 3 can be upgraded to an absolute title

The Register

Central to the system of registered land
Kept by the Chief Land Registrar (s.1 LRA 2002)
Open to public inspection
Divided into 3 parts:
1. Property Register
Description of the land including any benefits
2. Proprietorship Register
Name/address of proprietor, price paid and any limitations to the right
3. Charges Register
Interests of 3rd parties affecting the land, e.g. covenants/mortages/easemnts
Registration provides ownership of the land (to a purchaser or inheritance)
Registration also protects 3rd party interests
NOTICES: If you believe you have a right in the land but the land owner disputes it the then
you can protect the dispute by asking the land registrar to enter into a unilateral notice
against the land on the Chargers’ Register

First Registration of Title

Unregistered land transfers onto the registered land system
