- The law commission is an independent full time body that reviews
laws (separate from government)
- It is set up under the law commission act 1965
- The law commission act identifies areas of law that are believed to
be in need of reform
- Includes 5 commissioners – legal experts – including a high court
judge
- ^ each of the 5 also have their own qualified team
Process –
- Research – areas of the law are researched, a consultation paper is
drafted, which suggests and identifies problem and proposals
(things that would be changed)
- Working paper – It then publishes a consultation paper (paper that
describes law, the problems with it and then looks at options for
reform) seeking views and feedback on possible reform
- Consultation – the response’s will be used for drawing up positive
proposals for reform
- Report – they will then be presented in a report often with a draft
bill attached

The law commission can do 3 things –
Codification –
Bring together any type of law and make it to one act of parliament
For example, offences against the person act 1861, brings all the
acts, laws, ordinary laws and even rule law about offences against
human together
Consolidation –
Bring together act of parliament and makes it into one single act
For example the education act 1996 brings together everything
relevant to education and puts it under one act of parliament
Repeal –
Old laws are repealed- get rid of
