P4: Explain how national initiatives promote anti-discriminatory
practice.
National Initiatives are legislations and code set by the government to ensure people are protected.
They are in place to show people how to behave in some situations, be aware of certain issues and
promote anti-discriminatory practice.
Anti-discriminatory practice happens when any practice aims to counter discrimination in the UK
(based on race, class, gender, disability etc.) and promote equality by introducing anti-
discrimination policies in the workplace.


Convention:
The European Convention on Human Rights and Fundamentals Freedom 1950 is a European
document relating to human rights and it is signed by all governments in the European Union,
including the UK. It ensures specific rights and prohibits unfair and harmful practices.
This convention helps to promote anti-discriminatory practices by setting rights that people should
follow. Some examples may be:
 The right to life (Article 2)
 Freedom of thought, conscience and religion (Article 9)
 The right not to be discriminated against in respect of these rights (Article 14)
By having these rights in place, individuals might feel protected and understood.
An example in health and social care could be in a school where professionals should make sure
that the students have access to education and are not being abused.
A second example might be in a hospital where a muslim lady is wearing a hijab, but the workers
are discriminating towards her. It is important for the workers to adhere to article 9 which is the
freedom for someone to follow and express one’s religion or beliefs.
This convention is important because it obligates individuals to recognize and respect human
rights.

Here are three legislations:


1. Equality Act 2010 and include the amendments of 2013 (civil partnership)
The Equality Act 2010 brings together over 116 separate pieces of legislation into one single
Act which protects people from biased treatment and supports a fair and more equal
society. It also protects equal treatment to individuals that are married or in civil
partnership.
Some of the legislation pieces that merged are:

 The Equal Pay Act 1970
 The Disability Discrimination Act 1995
 The Equality Act (Sexual Orientation) Regulations 2007

By supporting equality and having in place various pieces of legislations that look after
individuals no matter their disability, religion, gender, race and sexual orientation is helping
in promoting anti-discriminatory practice.
For instance, in a residential home two care workers from opposite gender are doing the
same job since they have the same qualifications and experience, for that reason they
should be able to get equal pay and avoid any type of discrimination.
This Act extremely important because it promotes equality and same rights between
different individuals.

2. Health and Social Care Act 2008 Regulations 2014
This act has different legislations that minimise discrimination in health and social care. It
helps prevent people from receiving and giving unsafe care and treatment.
Health and social care act 2008 regulations 2014 promotes anti-discriminatory practice by
preventing inequality and discrimination between individuals in health and social care.
For example, in a care home is important for the care workers to promote the service user’s
wellbeing by treating him with respect and dignity.
This act is important because it ensures that service providers treat everyone in a fair way
regardless of their differences.

3. Human Rights Act 1988
The Human Rights Act gives influence on the human rights set out in the European
Convention on Human Rights. This act protects everyone in the UK no matter the nationality
or citizenship.
Public authorities must follow, respect and protect a person’s human rights in everything
they do. If they do not abide by the Human Rights Act then the person could act in court.
The act helps promoting anti-discriminatory practice by giving each person rights that if
they are not being met the individual could seek for legal action.
For example, in a care home an elder should be able to express himself by sharing his
opinion and thoughts without anybody stopping him since he has the right to do so.
This act is important because it safeguards every individual’s rights and it gives them the
chance to take legal action against any person or organisation that breaches those rights.


Policies:
1. Health and Safety Policy
This policy sets out how a service plans to manage health and safety issues.
The health and safety policy promotes anti-discriminatory practice by following the plans
set out for the staff members, recruiting the right individuals and training them.
For example, in a hospital all new workers should be able to go through training regarding
procedures and health and safety regulations because by giving them the chance to learn
they would be able to provide effective care to the patients avoiding mistakes and risks.
This policy is very important because it helps service providers be safe and give the right
and suitable support to the patients by ensuring they are aware of the plans that are put in
place for any health and safety issue.
