Confidentiality is the act of keeping information in confidence between the service user and the practitioner,
which is one of the most important aspects of good and quality care practice. However, there is no such thing
as absolute confidentiality in health care settings because there are some situations where it is vital for a
service professional to breach confidentiality for the sake of the service user, for example if their life were at
risk or they may need to reveal information about an individual in court. If confidentiality were broken under
different circumstances it can mean a loss of trust between the professional and service user leading to both
a loss of dignity and embarrassment but may also cause that service user harm.
Within these settings maintaining confidentiality is crucial in order to meet the service users’ needs effectively.
It is important because individuals who are being cared for need to be able to trust the care workers so that
the professionals receive enough substantial information so that they can be supported effectively and at a
high quality. For example, Martin may feel confident that professionals won’t breach confidentiality and tell
them he struggles with reading complex instructions, therefore meaning they can cater this care more
specifically to his needs. However, if this confidentiality is broken then Martin may lose trust in the health and
social care professionals, leading him to not share important information with them in the future, which could
worsen any treatment he receives.
It is important for that both service professionals and health care organisations keep informed of, and up to
date with relevant laws. Legislation, such as the Data Protection Act 1998 and the Human Rights Act 1998,
are an important aspect of maintaining dignity for those using health and social care services. Specifically
stated within the Data Protection Act is the idea that law requires all public bodies, like the NHS, to comply
with a range of data protection principles. Laws ensure that human rights are upheld, which in the context of
confidentiality means that providers shouldn’t make decisions that involve breaching a service users
confidentiality. Laws are also put in place to protect service professionals like doctors and therapists is
confidentiality is broken. Legislations can provide guidelines about correctly storing and sharing data about
service users. However an example of when confidentiality can be breached is if a service users life was at
