REQUIREMENTS: To succeed in this tort the claimant must show:

1. That the defendant brought something onto his land;
2. That the defendant made a “non-natural use” of his land (per Lord Cairns, LC);
3. The thing was something likely to do mischief (Unfug) if it escaped;
4. The thing did escape and cause damage.

DAMAGES: The owner of land close to the escape can recover damages for:

1. Physical harm to the land itself (as in Rylands v Fletcher) and to other property.
2. It is no longer clear if a claimant can recover for personal injury.

DEFENCES:

1. Consent
2. Act of a Stranger
3. Common benefit
4. Act of god ‘no human foresight can provide against, and of which human prudence is not
bound to recognise the possibility’
5. Default of a stranger

 Under the Land Registration Act 2002, Schedule 3 (and its predecessors), certain interests
are ‘overriding’, meaning that even if they are not registered they can be asserted against
those with registered interests in the property. One of these overriding interests is any
interest belonging to a person in actual occupation of the property (para. 2).
 Decision: The House of Lords held the wife had no overriding interest, and so the bank could
take possession of the property. The House of Lords held that the necessary interest had to
be proprietary (eigentum).

- Liverpool City Council v Irwin [1976] UKHL 1
 Irwin: Irwin withheld rent based on the fact that the common parts of the building
were not properly maintained by the city council.
 City council: City council said that there was no such obligation to maintain in the
contract
