Case C-55/94 Gebhart
relevant law provisions: chapter 2 and 3 of the TFEU and directive 77/249
Gebhart is a German lawyer, who moved to Milan with his family to open
his own practice. He used the title avvocato for professional purposes. The
Milan Bar Council prohibited mr Gebhart from using this title. Gebhart
argued that he was protected by directive 77/249. For this it is important
that Gebhart is not providing services in Italy but is established in Italy.
The Consilgio Nazionale Forense asked the Court for a preliminary ruling
on two main questions (§18):
1. What factors determine whether the provision of services by a
lawyer happens on a temporary basis?
2. What measures can Member States (MS) take to hinder lawyers
from other Member States to take practice in their country?
To the first question the Court responds that the pursue of economic
activity is either governed by chapter two of the EC Treaty, the right of
establishment or chapter 3 of the EC Treaty regarding services, these two
being mutually exclusive (§20)
The temporary nature of someone’s activities have to be determined in
the light of the duration of the provision of services, the regularity, the
periodicity and the continuity. If the provider of service does this on a
temporary basis this doesn’t mean this person may not equip himself with
necessary infrastructure such as an office. This §graph also contains a
definition of establishment. (§25-27)
In responds to the second question the Court firstly states that under
article 43 EC Treaty, the freedom of establishment is to be exercised
under the conditions of law laid down for the nationals of the Member
State where the person has established. (§33)
It is however possible for Member States to have certain provisions laid
down by law for foreigners (from other Member States) to protect activities
that require a specific qualification. But take into account the relevant
diplomas (mutual recognition) (§35)
These measures to hinder fundamental freedoms given by the Treaty must
fulfil four conditions:
-They must be applied in a non-discriminatory manner
-They must be justified by imperative requirements in the general
interest
-They must be suitable for securing the attainment of the objective they
pursue
-They must not go beyond what is necessary in order to attain it.
