Contract
Mutual agreement between 2 or more parties with the intention, to obtain legal effect. Private law,
book 3 + 6 + 7 DCC.
There are no formal requirements in the formation of a contract, only 2 persons who are 18+ and
sane. The fundament of contracting is freedom, limited by mainly criminal law and laws regarding
public morality and public order.
FE: You can have a contract for dealing drugs but it is not legal, so you cannot go to court with it.
The content of a contract is free but not if it touches criminal law or public morality.
To agree on a contract you need 2 personal requirements.
1. Sanity You can only be legally insane when a judge says so. (Onder curatele gestelden)
When you seem sane, and you are not, the contract is also binding.
2. Age When you are under 18, you need permission from your parents.
