Describe the meaning of terms in a standard form contract (task 3 a)
P5:
Explain the effect of the above terms in your chosen contracts (task 3 c)
These tasks are obviously linked. The p4 part tackles the theory and the p5
part applies this theory to your contracts. Application means you are
supposed to judge how effective the terms are i.e. what added clarity do the
terms add to the contracts (reading for the tasks pgs. 93-97)
P4:
1. What is the definition of terms
2. Types of terms: express (definition) and implied (definition)
3. Examples of the terms (look at grading tips in your assignment briefs)
For each example write down in your own words what you think it means.
P5:
Choose 2 contracts
1. Sale of goods (consider a b2b sales contract
2. Supply of goods/services (consider lease/service/import of product
contract.
What you should then do is identify the terms you mentioned in the p4 part
of the assignment and say what the effects of these will be for the parties of
the contract
