QUESTION 1
a.
A voidable civil marriage is a union where certain grounds existed before or at the time of the
wedding, which allow the court to set aside the marriage. Despite the presence of these grounds,
the marriage remains legally valid and has all the legal consequences of a valid civil marriage
until a court order sets it aside. If not annulled by the court, the marriage continues to exist and
impacts the legal status of the parties, such as property administration rights and the legitimacy
of children born during the marriage. The court order is essential to nullify a voidable marriage.
