Question 1: Preliminary Inquiry
1.1 Introduction
The Child Justice Act (CJA) 75 of 2008 is a law in South Africa that regulates the
criminal justice system regarding children in conflict with the law. It provides a
framework for a specialized approach to the handling of children in conflict with the
law and establishes procedures that are consistent with the principles of restorative
justice. One of the significant features of the CJA is the introduction of the
preliminary inquiry procedure, which replaces the traditional criminal trial process for
children. The preliminary inquiry is a new procedure introduced by the CJA to deal
with children in conflict with the law. The purpose of this paper is to provide an
informative discussion of the preliminary inquiry, focusing on its definition, nature,
purpose, general themes, and objectives.
