, QUESTION 1: CIVIL PRACTICE
1.a) The aim of exchanging pleasantries with a potential client is to create the first
impression that the potential client will have of their prospective lawyer as this will
be a lasting one, the client is also introduced to their prospective lawyer. This
process makes the potential client feel comfortable in speaking with the
prospective lawyer. It is a fundamental step of building rapport with a prospective
client, to show them that the person they have come to for help views them more
than a business transaction and it sets the tone for how the prospective
relationship will go on.
b) Maintaining a chronological account of facts when interviewing a client:
> allows the lawyer to gather information in the same order that he would be
required to do so in a court
> by a client recalling events in this fashion and order it allows for more of an
accurate recall of the facts as they happened as the client states the facts as they
happened giving a complete picture of the scenario.
> the story telling narrative of this method where one fact leads to the next allows
for a much better understanding.
> the context of smaller events are better understood in the background of the
bigger story being told.
> allows for better organisation in drafting out statements and affidavits since they
would have to follow the chronological order of events.1
