1. Ubuntu is an African concept, that is uniquely identified to us. It encapsulates
different perceptions and definitions making it difficult to have a singular definition of the
concept of Ubuntu. Ubuntu in its simplest terms means humanness. Ubuntu is based on
the inherent belief that one is never alone, as expressed in the African idiom “Motho ke
motho kabatho” (loosely translated as I am because you are).Applying Ubuntu in the
criminal justice system to ensure justice is rendered for victims, one needs to take into
account some important rights such as the right to human dignity. This human dignity,
which will ensure that victims get the justice they deserve.

Ubuntu enshrines fairness which spills over to the right to equality and to be treated
equally by the law and to be protected by the law. This then will dictate that victims be
equally protected by the law and get justice for the wrong that has been done to them.
The offenders will be punished accordingly. The victims of crime must be treated
equally regardless of their status whether they are rich or poor, black or white, male or
female. Ubuntu will make sure the victims get justice but it also moves away from
retribution and putting it emphasis on reconciliation between the parties and reformation
of the offender. It also encapsulates forgiveness.
