1. In the case of H v W, Judge Nigel Willis had this to say "...The law has to take into
account changing realities not only technologically but also socially or else it will lose
credibility in the eyes of the people. without credibility, law loses legitimacy. If law
lose legitimacy, it loses acceptance, If it loses acceptance, it loses obedience. It is
imperative that the courts respond appropriately to changing times, acting cautiously

1.1. The Impact of social media on the constitutional right to privacy
In terms of South African law. The right to privacy is under the terms of the common
law and section 14 of the Constitution of South Africa 1996. Social media plays a
huge role in our society and forms an easy way of communication and status within
the current world, but with social media being beneficial there are complications with
the privacy of the people. Sharing one’s details with companies or store markets for
benefits whilst having to deal with options of being tracked or pestered by
advertisements seems to be as if the privacy of a person’s communication being

A person may share something and depend on the content of what’s been shared,
the shared post may be in the possession of other people who had found such post.
This can also be viewed as a way for someone to mock or cause hatred to the
person who initially shared. People should be aware that once someone posts
private information on social media; their information can be published of sort by
normal forms of media or news.
1.2 Freedom of Expression
The right to freedom of expression entails that a person has the freedom of the press
and other media; freedom to receive or impart information or ideas; freedom of
artistic creativity; and academic freedom and freedom of scientific research.
However, this does exclude propaganda for war; incitement of imminent violence; or
advocacy of hatred that is based on race, ethnicity, gender or religion, and that
constitutes incitement to cause harm. Social media has benefited the right to
freedom of expression, through the constant sharing of opinions and other forms of
expressions mentioned within the right. Social media assists people depending on
the situation; social media is forever growing and with that comes the assistance of
others who will try to help through cyber protests or spreading the word of the current
situation of the problem at hand. Although social media may be something that may
negatively affect people’s freedom of expression. It instead gives provides an
opportunity for a vast amount of people to share their form of expression and thus
creating a positive impact within many lives.

income
grants, eligibility for housing or pensions, and weakens service delivery. If service
